Jurisfy is a company assisting Attorneys, Advocates and Laymen to easily access courts, sheriffs and the legal system. Jurisfy, whilst providing the network, maps and details of Attorneys, Courts and Advocates, does not practice in the legal field nor provides legal services to anyone.

By using the Jurisfy website and services you unequivocally agree to the following terms and conditions of use. Before continuing with the service we advise you to make yourself conversant with the terms and conditions below.

1. Use

  1. Upon registration and payment jurisfy will register the user a license of use. This license is non-transferable and only entitles the holder thereof to utilize the service for a limited period.
  2. Jurisfy retains the right to withdraw the license at any time should the user:
    1. Grant access to the service to a 3rd Party who has is not a license holder.
    2. Abuse the Jurisfy service
    3. Furnish knowingly false or misleading information to Jurisfy with regard to the license holders identity or any other such information.
    4. Fail to pay any amounts in arrears with Jurisfy.
  3. Jurisfy retains the right to withhold a license from anyone for whatever reason they deem fit.
  4. Your Jurisfy license will automatically renew on the 1st of each month should the holder thereof not provide a written notice of cancellation on or before the 25th of the month prior.
  5. Use of the site is only for lawful purposes and any unlawful use will result in immediate cancellation of your licence.
  6. You further warrant that:
    1. you have the necessary capacity, authority and power to enter into and perform in terms of this agreement;
    2. you own or otherwise control all rights to the content that you may submit to the Site;
    3. that any use of such content will not infringe or violate any third party rights or copyright laws, nor cause injury or harm to any person or entity;
    4. Jurisfy is permitted to use, reproduce, display, perform, adapt, modify and distribute your content;
    5. the information you provide is accurate, current and complete, and that you will use reasonable efforts to maintain and timeously update your information;
    6. you indemnify Jurisfy or its affiliates, directors, officers and employees, for all claims resulting from the submitted content; and
    7. you will comply with all applicable laws regarding the technical transmission of data, acceptable content and online conduct.
  7. You authorize Jurisfy to contact you and include you in correspondence relating to new products and services.
  8. You remain solely responsible for the integrity and safety of your username and password. You further warrant that any person using your username and password does so under your authority as your agent. Jurisfy can and will regard any purchases, renewals or upgrades to your license to be binding.
  9. Jurisfy permits certain license holders to submit their details to the Jurisfy website. Jurisfy provides this information to other users “as is” and is under no obligation to review, ensure the correctness, correct or remove this information.
  10. You warrant that any information submitted to the Jurisfy website is entirely your own and that all copyrights and trademarks vest in yourself. You further indemnify Jurisfy against any claim arising from information submitted by yourself or on your behalf.
  11. Jurisfy cannot be held liable for any interruption in service, on its or your part nor can we guarantee uninterrupted, error-free access to the site at all times.
  12. Jurisfy retains the right to close the site for any reason whatsoever, and you agree that Jurisfy will not be liable for any loss sustained as a result of the site being inaccessible for any period.

2. Jurisfy Proprietary information

  1. All content on the Jurisfy website and service remains the exclusive property and copyright of Jurisfy protected under South African and international copyright laws. Any theft, duplication, piracy, reverse engineering or replication of the proprietary information will result in the immediate cancellation of the user’s license as well as legal action against the infringer.
  2. Whilst every effort has been taken to ensure the correctness of the information on the Jurisfy service, Jurisfy cannot warrant the correctness thereof and Jurisfy insists that the user always check the information’s correctness before utilizing same.
  3. Jurisfy cannot be held responsible for any inaccuracies or mistakes contained on the website and any loss sustained as a result of the use of the service lies solely with the user.
  4. Jurisfy offers no guarantee of increased revenue or an increase in customers or correspondents by utilizing the service.
  5. It remains the sole responsibility to users and licence holders to maintain and update their information periodically and accurately, Jurisfy cannot be held responsible for any loss as a result of outdated company or user details.
  6. Jurisfy permits a limited right to hyperlink to the Jurisfy website, provided that the hyperlink does not defame or derogate Jurisfy in any regard.
  7. The Jurisfy logo, slogan or any such identifying characteristic is the sole property of Jurisfy and any infringement, defamation, duplication or derogation thereof will result in legal action being taken against you.

3. Billing and Pricing

  1. Jurisfy utilizes payu.co.za billing system and by utilizing the jurisfy you also agree to the terms and conditions of payu.co.za/ which can be found here: https://www.payu.co.za/legal
  2. Jurisfy cannot be held liable for any negligence, incorrect billing, fraud, or otherwise as a result of the actions of payu.co.za
  3. All prices, billing terms, payment terms and otherwise are binding on the user.
  4. All payments are final and binding and no refunds will be provided should you wish to cancel the service prior to the expiry of the purchased term
  5. All payments made are bound to the user which purchased them, Jurisfy will not be obligated to transfer credit from one account to another for any reason whatsoever.
  6. You authorise Jurisfy to bill the payment source you provide to Jurisfy for all applicable charges. If your payment is declined or not met, Jurisfy reserve the right to disable or cancel your use of Service at any point without prior notification to you. We reserves the right to charge interest on all overdue amounts. The interest on overdue amounts shall accrue at the maximum rate permitted by law from the date such amount became due, until payment is fully satisfied. In the event of overdue amounts, you are responsible for all reasonable expenses (including legal fees) incurred in order to receive any outstanding amounts due. If We are required to collect or pay any taxes relating to your use of the Service, you will be charged for all such taxes. If you are tax-exempt, you must provide Us with a valid tax exemption certificate authorised by the appropriate tax authority.

4. Privacy policy

  1. By utilizing the Jurisfy service you agree to the collection and use of your personal information as specified.
  2. Jurisfy respects your privacy. Any personal information provided to Jurisfy is treated as confidential. This information includes, but is not limited to, your full name, postal address, email address, phone number and any other information that identifies you. Jurisfy may collect other information from you when you utilise the Service, for example, through cookies and other sources related to the nature of our business.
  3. Any information submitted to jurisfy for the purposes of advertising and publicity is displayed on the service as provided by you. You further warrant that the information provided is:
    1. not of a confidential nature.
    2. given by yourself freely and voluntarily.
    3. given with the necessary authority to distribute the information.
    4. true and correct to the best of your knowledge.
  4. You authorize Jurisfy to contact you regarding the service and send you any communication regarding the Jurisfy service, including our newsletter.
  5. When you visit Our Service, We collect and store the information you unknowingly provide about your visit. This information enables Us to better the Service Jurisfy provides. We may share this information with Our business partners. This information includes but is not limited to:
    1. the date and time of your visit to the Service;
    2. the pages you visited on Our Service;
    3. the browser you used;
    4. the operating system and language You used;
    5. the IP addresses used; and
    6. the referring web address from whence You came
  6. In visiting Our Service, a text file called a cookie may be placed on your computer’s hard-drive. A cookie is valuable to you in that it allows you to take full advantage of the Service. We recommend you accept cookies if your web browser offers you the ability to accept or decline the text file. A cookie allows Us to recognise you, the user. 5. Submission of data to Jurisfy

  1. You are prohibited from posting or transmitting, by means of reviews, comments, suggestions, ideas, questions or other information through the Site, any content which is, unlawful, offensive, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically or otherwise objectionable content of any kind, including but not limited to:
    1. any content that encourages conduct that would constitute a criminal offence, or give rise to civil liability, or otherwise violate any applicable local, provincial, national, or international law; or
    2. any content that constitutes an invasion of privacy; or
    3. any content that is an infringement of any intellectual property right; or
    4. any content that contains software viruses; or
    5. any content that constitutes a political statement, commercial solicitation, or “spam”.
  2. Although Jurisfy does not purport to (nor is it under any obligation to) review any submitted content, it reserves the right to remove any content from the Site that it deems, in its sole discretion, to be an infringement of Clause 1 or harmful in anyway whatsoever. In these circumstances, you will have no claim against Jurisfy. Should you breach any clause in these Terms of Use, Jurisfy may immediately terminate or suspend: your access to all or any parts of the Site; and/or your use of the Service; and/or your advertisements without any further notice to you.
  3. You warrant that:
    1. you have the necessary capacity, authority and power to enter into and perform in terms of this agreement;
    2. you own or otherwise control all rights to the content that you may submit to the Site;
    3. that any use of such content will not infringe or violate any third party rights or copyright laws, nor cause injury or harm to any person or entity;
    4. Jurisfy is permitted to use, reproduce, display, perform, adapt, modify and distribute your content;
    5. the information you provide is accurate, current and complete, and that you will use reasonable efforts to maintain and timeously update your information;
    6. you will indemnify Jurisfy or its affiliates, directors, officers and employees, for all claims resulting from the submitted content; and
    7. you will comply with all applicable laws regarding the technical transmission of data, acceptable content and online conduct.
  4. If you downgrade features relating to your service, you understand that you may lose portions of your content. You agree that Jurisfy will have no liability to you of any kind arising out of or related to loss of your content.
  5. You authorise Jurisfy to send electronic and other transmissions of any current and future data that is loaded into the Service to you.
  6. The following activity on or through the Site is expressly prohibited:
    1. any non-personal or commercial use of any robot, spider, other automatic device or technology, or manual process to monitor or copy portions of the Site, or the content contained therein, without the prior written authority of Jurisfy; and
    2. the collection or use of any listings, descriptions, or price-lists from the Site, for the benefit of a competing merchant that supplies products comparable to those offered on the Site; and
    3. any use or action that imposes an unreasonable or disproportionately large load of traffic on the Site, or otherwise interferes with its proper and timely functioning.

6. Responsibility

You are responsible for maintaining the confidentiality and security of your username and password for access to the Site, and you accept full liability for all activities that occur under your username. You agree to inform Jurisfy immediately of any attempted or actual unauthorised access or use of the Service and/or any security violations. You acknowledge and agree that Jurisfy will not be liable, directly or indirectly, for any damages of any kind incurred as a result of such acts or unauthorised access or security violations.

7. Electronic Communications Act

You agree, in terms of Section 42(2)(d) of the Electronic Communications and Transaction (ECT) Act 25 of 2002 that the Service begins with your consent before the end of the seven day period referred to in Section 44(1) of the ECT Act.

8. Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa without giving effect to the principles of conflicts of laws. You hereby consent to the non-exclusive jurisdiction of the High Court of South Africa, Gauteng Local Division in respect of any disputes arising in connection with this website.

9. Variation and relaxation

  1. Jurisfy retains the right to change these Terms and Conditions without notice to you and we advise that you check these Terms and Conditions periodically.
  2. Any relaxation of these Terms and Conditions on a user will not be binding on Jurisfy and notwithstanding such relaxation, Jurisfy retains the right to enforce the Terms and Conditions as set out above.
